Wisconsin State Statute Chapter 948 includes sexual assault and all other crimes against children. First Degree Sexual Assault Of A Child is a felony and is defined as sexual intercourse or sexual contact with a child who has not attained the age of 13 years. The penalty for this crime is imprisonment not to exceed 40 years. Second Degree Sexual Assault Of A Child is a felony and is defined as sexual intercourse or sexual contact with a child who has not attained the age of 16 years. The penalty for this crime is imprisonment not to exceed 20 years or a fine not to exceed $10,000, or both. Sexual Intercourse With A Child Age 16 Or Older -- Sexual intercourse with a person 16 or 17 years old is a misdemeanor, the penalty for which is imprisonment not to exceed 9 months or a fine not to exceed $10,000, or both. Sexual Assault of a Student by a School Instructional Staff Person -- Sexual intercourse or sexual contact with a child who is at least 16 years old who is enrolled as a student in a school or school district in which the assailant is a member of the school or school district staff. The penalty for this crime is imprisonment not to exceed five years or a fine not to exceed $10,000, or both. Incest with a Child -- Marriage or sexual intercourse or sexual contact with a child the assailant knows is related, either by blood or adoption, and the child is related in a degree of kinship closer than second cousin, or is a person responsible for the child's welfare and has knowledge that incest may or has occurred and is capable of taking action yet fails to take protective action. The penalty for this crime is imprisonment not to exceed 20 years or a fine not to exceed $10,000, or both. Causing a Child to View or Listen to Sexual Activity -- Intentionally causing a child to view or listen to sexually explicit conduct for the purpose of arousing or gratifying the perpetrator or humiliating or degrading the victim. If the child has not attained the age of 13 years, the penalty for this crime is imprisonment not to exceed 10 years or a fine not to exceed $10,000, or both. If the child is between 13 and 17 years old, the penalty for this crime is imprisonment not to exceed 5 years or a fine not to exceed $10,000, or both. Soliciting a Child for Prostitution -- Intentionally soliciting or causing any child to practice prostitution or establishing a child in a place of prostitution is a felony. The penalty for this crime is imprisonment not to exceed 20 years or a fine not to exceed $10,000, or both. Statutes of Limitations for Child Sexual Assault or Abuse -- Prosecution for the following crimes that occurred after April 7, 1994 must begin before the victim reaches 26 years of age: sexual assault of a child under 16 years old, physical abuse of a child, causing mental harm to a child, sexual exploitation of a child, incest with a child, child enticement, soliciting a child for prostitution, and sexual assault of a student by a school instructional staff person. Prosecution for the same crimes as listed above that occurred before April 7, 1994 must begin within the time frame allowed for felony crimes or before a victim/survivor reaches age 21, whichever is later. |
